Would I be rehired?

I used to work at Marshalls for a few days over a year in September 2021-2022.

I never had any write-ups or attendance issues and was relatively problem free. I would even go as far as to say I was pretty good at it and I liked being there most of the time.

When I left, I put my two weeks in and on the day of my last shift I decided to call out (I don’t remember if I was sick or just didn’t want to go, but I most likely said I was sick). Flash forward to mid 2023 when I wanted I side job while I waitressed and I reapplied to Marshalls. Weeks went by with no response of any kind. I tried calling once day and I was told I would get a call back from them and never did. One of the friends that I met when I first started working there was still there, so they talked to the managers about my application. They said that because I called out in my last day that they legally could not rehire me which totally confused me because I didn’t even know that was a thing.

Now it’s 2024 and I have a full time job with short days and I have extra time to pick something up a few days a week. I have heard that management has changed and almost everyone that had been in charge is gone.

My question is does anyone think they will decline my application?

TLDR; I worked for TJX and was a good employee but called out on my last day. Can I be rehired?
