Is it a lemon?

Brand new 2024 Chevy Trax started making loud engine noise during acceleration and check engine light came on. Had vehicle towed to dealership, they are now saying they will have to order a new engine and that could take weeks. Is this a lemon law situation? Any advice on next steps?
